What changed for TDS from 1 April 2026

The Income-tax Act, 2025 replaced the Income-tax Act, 1961 from 1 April 2026. The separate TDS sections 193 to 194T have been merged into a few sections with tables:

  • Section 392 covers TDS on salary (old section 192).
  • Section 393(1) is one table of payments to residents: commission, rent, contracts, professional fees, interest, dividends, purchase of goods and so on. Each entry is cited by its serial number, for example "393(1) Table Sl. No. 6(iii)" for professional fees.
  • Section 393(2) covers payments to non-residents, and section 393(3) covers items such as lottery and online-game winnings, cash withdrawals and payments to partners.

Challans and TDS returns now identify each payment by a four-digit payment code (1004 to 1067) instead of the old section number. The chart above maps every code to its old section, new section, rate and threshold, so you can keep using the section numbers you know.

TDS due dates

TDS deducted in a month must be deposited by the 7th of the next month. TDS on March deductions can be deposited up to 30 April. Quarterly TDS returns are due on 31 July (April-June), 31 October (July-September), 31 January (October-December) and 31 May (January-March). See every date, with reminders, in our compliance calendar.

What happens if TDS is not deducted or deposited

  • Expense disallowed. 30% of an expense on which TDS was not deducted or deposited is disallowed in the payer's business income, until the TDS is paid.
  • Interest. Interest is charged for the delay in deducting and in depositing TDS, for each month or part of a month.
  • Penalty and late fee. A penalty equal to the TDS not deducted can apply, and a daily fee is charged for each late TDS return.
  • No PAN. If the payee does not give a PAN, TDS is generally deducted at a higher rate, usually 20%.
